When Am I Divorced & How Long Will it Take?
When Am I Divorced?
The divorce process can be somewhat complicated and you’ll hear things like filing and serving the complaint, and the discovery process. You may have to attend different hearings on dividing the marital property, child and spousal support, child custody and other matters. And along the way you might be wondering “how will I know when I’m finally divorced?”
You’re finally divorced when you get an order from the court in the form of a divorce decree. Until you get that divorce decree, then you’re not divorced. Click HERE to see what a divorce decree looks like. Until you receive a form that looks like that, you’re still married no matter what else went on in the process. So make sure you get it or you’re not divorced.
How Long Will My Divorce Take?
If the spouses agree, you can get divorced in as little as 120 days, or about four months. If the for some reason one of the spouses does not want to get divorced, then once a year has passed, the divorce can go through even if one of the spouses doesn’t want it to happen.
