Child Custody Orders Can be Changed
A child custody order is never final and is always subject to the review and change when it is in the best interest of the child to do so. The court calls a change in an existing custody order a modification. For many years in Pennsylvania, if you wanted to change an existing custody order, you had to prove that there has been a substantial change in circumstances since the previous order was put in place. That’s no longer the law.
The current law only requires that any change to an existing custody order must be based on the best interest of the child. To begin the process to get that change, you have to file a petition to modify in court. The court is required to consider the 16 factors to determine if a change is the existing child custody order is the best interest of the child.
