You Much Do I Have to Pay My Attorney?
Typically, the attorney fee in a car accident is paid only if the lawyer forces the other driver’s car insurance company to pay you money for your damages caused by the car accident. If the attorney is not able to do that, then you don’t pay an attorney fee regardless of how long your attorney worked on the case. We call that a contingent fee agreement.
The amount of the attorney fee is based on a percentage. There’s no Pennsylvania law saying what that percentage should be, but the typical percentage is one-third of the amount recovered if the case is settled, and that percentage may increase if a lawsuit has to be filed and the case decided by a jury. Most attorneys explain to their clients in a written contract the attorney fee and costs. Make sure your attorney prepares this contract so that there are no misunderstandings of how much you’ll have to pay.
