Will You Be Able to Settle My Case?
That depends. Once the lawyer estimates the value of the claim, the lawyer will get your permission to settle the case for that amount. The lawyer will present that claim to the other driver’s insurance company, along with documentation supporting the basis of the value, and demand that the insurance company pay that amount to settle the case. Whether or not the case can be settled depends on the insurance company’s response. For example, if we estimate the value of the case to be $62,700, and the insurance company only offers $7,500, then you have two choices. Either accept the insurance company’s low ball offer for $7,500, or go to a jury trial hoping the jury will decide the case closer to your lawyer’s estimated value. Again, it’s tough to estimate the value of a case with certainty because no one can predict the amount of money a jury will decide for non-economic damages. However, convincing a jury to use the four step process to calculate non-economic damages makes sure the jury’s decision is rational, and not a guess or a flat refusal to do it.
