If We Can’t Settle the Case, What Happens Next?
If your case cannot be settled for a fair amount, then the court allows your case to be decided by a judge, jury, or appointed individual. In almost all cases, the best method is to have a jury decide your case. A jury is a group of individuals that is randomly selected from your community. Before the jury system, cases were decided by judges and appointed individuals. The reason why we changed to a trial by jury is because cases were often decided not by the rule of law, but in violation of it, unfairly, in favor of the wealthy and well-connected against the average citizen; the wealthy and well-connected were able to corrupt the judge or the appointed individual. It is much more difficult to corrupt randomly selected individuals from your community. However, this doesn’t mean the insurance industry hasn’t tried to do that. For over 30 years, the insurance industry has used the media and has corrupted politicians to convince people in the community that injury lawsuits are the cause of all the bad things in their life to avoid paying legitimate claims to maximize their profits. And to some extent, it has worked, and made it more difficult to get a jury without people who have not bought into the insurance industry lie. However, a rigorous jury selection process can help get individuals off a jury who refuse to follow the law and seek to destroy your case because they have bought into the insurance industry lie.
