How The Insurance Company Will Try to Use
the Sucker Punch Approach on You—“Aw, No, You don’t Need a Lawyer”
If you were forced to fight in a war, wouldn’t it be great if you could take away your enemy’s main weapon? That’s what the other person’s insurance company tries to do to you. The insurance company’s main weapon is a group of lawyers advising it on how to destroy or severely damage your claim. Your main weapon is a lawyer who only represents people against insurance companies and has a history of proven results. The insurance industry’s main strategy in its sucker punch approach is to make sure you don’t hire that type of lawyer. It can’t do that by acting like your enemy, which it is, because if it did, you’d automatically realize you’re in a legal fight and hire a lawyer. Instead, it acts very friendly and assures you that it will fully compensate you for the money you lost or the physical injuries you suffered from a car accident. Hey, if they’re doing what they’re supposed to do, who needs a lawyer, right?
So here’s how it works. It starts with a phone call from the other person’s insurance company to you that goes something like this: “Hello, this is so and so from insurance company. So very sorry to hear that you were in a car accident.” The insurance company will ask you what happened, listen to your story, and make you feel that it sincerely cares about what happened to you and that it wants to help. If you ask if you should get a lawyer, the response will go something like this:
“Aw, no, you don’t need a lawyer. If you give us the information we need, we will offer a ‘fair amount’ to settle your claim quickly. If you hire a lawyer, it will delay the process, and you’ll have to pay an attorney fee.”
That’s how the insurance company goes about separating you from your main weapon– a lawyer who only represents people against insurance companies and has a history of proven results. That’s the tap on the shoulder right before the insurance company tries to punch you in the face.
Once the insurance company separates you from your lawyer, this is what typically happens:
- It is able to convince you to act against your own interest and settle your claim for only a fraction of its value; or
- It is able to delay you from acting to protect your legal rights by giving you sucker punch assurances that it will ultimately settle your claim for a fair amount.
At some point, most people will realize that the insurance company is doing the opposite of what it is telling you it will do, and begin to fight back. By this time, however, your delay could have already destroyed your claim by having you not act within the time allowed to file a lawsuit, or it is so late in the process, and you’ve done so much damage to your claim by cooperating with your enemy, that no lawyer will take your case. Settling for a fraction of your claim’s value, destroying your claim, or severely damaging your claim, is the insurance company’s sucker punch in the face. Don’t let it happen!
