Your Lawyer’s Investigation of Liability
Now, just because you believe that the other driver’s at fault, doesn’t mean that you’re right. Legal Liability is a complicated issue that can only be determined by an experienced lawyer and a thorough investigation. Obviously, in some cases, liability is clear—for instance, if the other driver runs a red light or rear-ends you. Those are typical car accidents where liability is clear. However, even in those cases, I’ve had the insurance companies try to deny liability and fight the case.
So how does your lawyer go about investigating liability? First, you must get a copy of the police report. The police report is a description by the investigating police officer of what happened. It also identifies the drivers, their cars, and contact information. The police report sometimes identifies people who were not involved in the accident, but witnessed it. If there are witnesses, then your attorney will interview those witnesses and may get them to sign written statements of what happened. Your lawyer should go to the location of the accident and check it out. In some cases, it is necessary to hire an investigator to investigate the accident and give the investigator’s opinion on who caused it. Once your lawyer completes the liability investigation and determines that the other driver and or other parties caused the car accident, your lawyer will then investigate if the car accident caused you to suffer damages.
