Economic Damages in Car Accidents
The following are the economic damages in car accidents:
Property damage— if your insurance policy did not cover damage to your car, then you can sue the other driver’s insurance company for the costs to repair your car or its fair market value at the time of the accident. Also, if your insurance policy covers damage to your car, but you have to pay a deductible, then the other driver’s insurance company would be responsible for the deductible too;
Past Lost Wages–if your physical injuries caused you to be unable to work for a limited time, let’s say six months, and your insurance policy did not have a lost wage benefit, then the other driver’s insurance company would have to pay you for those six months of lost wages;
Future Lost Wages–if your physical injuries either prevent you from working in the future, or limit the amount of wages that you could earn in the future, and your insurance policy did not have a lost wage benefit, then the other driver’s insurance company driver would have to pay for those future lost wages;
Past Out-of-Pocket Medical Expenses–if you did not have some type of medical insurance at the time of the accident, or if you had medical coverage but you had co-pays and deductibles, then the other driver’s insurance company will have to pay for those out-of-pocket past medical expenses;
Future Out-of-Pocket Medical Expenses–if you suffered a physical injury that would cause you to need medical treatment in the future, then the other driver’s insurance company would have to pay you for those future medical expenses;
Other Economic Damages—For example, if, before the car accident, you cleaned and did work around the house, and after the accident, your physical injuries prevent you from doing that, and now you have to pay someone else to do it, then the other driver’s insurance company would have to pay for those expenses.
