Grandparent Child Custody & Visitation

The Pennsylvania courts have recognized grandparents’ right to custody or visitation of their grandchildren under certain circumstances.  Here are a few of them:

  1. Grandchild has lived with the grandparent for 12 consecutive months and then was removed from the home;
  2. The parent of the child is deceased; or
  3. Parents of the grandchild have file for divorce.

That’s not a complete list and there may be other facts and circumstances where a court would permit grandparents’ custody or visitation of their grandchildren.
