Expert Evaluations in Child Custody Cases
When there are allegations of abuse in a child custody case, whether physical, mental or some other form, the husband or the wife, or both, can ask the court to appoint an expert to do an evaluation. Even when neither parent wants an expert, the court may appoint one anyway if it appears that an expert evaluation may be helpful in making the child custody decision. The court will use the expert report, along with analyzing the other 16 factors required by law, to make its decision.
When it comes to doing a psychological evaluation, it’s important that the expert use the Guidelines for Child Custody Evaluations in Divorce Proceedings as adopted by the American Psychological Association in 1994 because that guide will be used to decide if the expert’s evaluation is any good.
