The following are your best options for where to keep your estate planning documents to protect them from fire, water damage or theft. Below I describe each option and some things to think about when determining which option is best for you.
1. Home Water and Fireproof Safe—a water and fireproof safe will protect your estate planning documents from water damage, fire damage, and theft so that you have them when the time comes. You have to make sure that the people who need to know have the lock combination so that they can get access to the documents.
2. Bank Safe Deposit Box—will protect your estate planning documents from water damage, fire damage, and theft so that you have them when the time comes. It’s best to have someone that you trust as a joint holder of the safe deposit box so that the people who need to know can get access to your documents when the time comes. If you have a living trust, you can title the bank safe deposit box in the name of the trust so that the trustees can get access to the documents.
3. Attorney—you can keep the estate planning documents with the attorney who created the estate plan to protect your assets and family relationships. Confirm that your documents are stored in a water and fire proof safe, and that people you trust know the identity of the attorney and law firm maintaining the documents.
